Service Terms and Conditions

 

1. These Service Terms and Conditions (“Terms”) apply to all bookings for My Condolences Workshop and one-on-one grief support sessions (“Services”) provided by Margaret Patricia Martin, ABN 59394120877, sole trader, trading as My Condolences Workshop (“we,” “our,” “us”). By booking a Service, you agree to be bound by these Terms.

2. Eligibility and Jurisdictional Restrictions: Our Services are not offered to any person who could bring a claim in a United States or Canadian court. This includes: anyone physically located in the United States or Canada at the time of booking or receiving the Service; citizens, permanent residents, or visa holders of the United States or Canada whose claim would fall under US or Canadian jurisdiction; and any person whose participation could subject us to the laws or courts of the United States or Canada. Any booking made in breach of this clause will be cancelled, and any payment received will be refunded, less applicable transaction fees.

3. Pricing and Payment: Payment is required in full at the time of booking. Workshop (standard): $90 AUD. Workshop (introductory): $50 AUD for bookings made up to 11:59 p.m. Australian Western Standard Time on 12 October 2025. The introductory rate may be used once per participant. If you attend more than one workshop, all subsequent workshops must be paid at the standard rate of $90 AUD. No concession rate applies to workshops. If cost is prohibitive, please email info@mycondolencesworkshop.com. One-on-one sessions (standard): $120 AUD. One-on-one sessions (concession): $80 AUD, available to holders of a valid Australian Government–issued concession card (Health Care Card, Pensioner Concession Card, or Veterans’ Affairs Card) or a current student identification card from a recognised educational institution. Proof must be provided at the time of booking or within 2 business days if requested. Failure to provide proof will require payment of the balance of the standard rate before the session is delivered. One-on-one sessions (limited-time offer): 30% off the standard rate when booked in conjunction with a workshop. The workshop and discounted one-on-one session must be booked during the promotional period, which runs until 30 November [year], and the one-on-one session must be attended within 60 days of the workshop date. Interaction of discounts: Only one discount, concession, or promotional rate may apply per booking. Discounts cannot be combined. For clarity: the introductory workshop rate cannot be combined with any other discount; the concession one-on-one session rate cannot be combined with the limited-time one-on-one offer; the limited-time one-on-one offer cannot be combined with the introductory workshop rate or the concession one-on-one rate. Refund basis: Refunds, where applicable, will be calculated on the amount actually paid.

4. Cancellations and Refunds (Customer-initiated): No refunds will be given for cancellations made within 7 days of the booked Service, except for illness supported by a valid medical certificate. Medical certificates must be provided electronically before the scheduled session, or within 2 business days if illness prevents prior submission. Failure to provide proof within this timeframe will result in the cancellation being treated as a non-refundable, non-transferable booking. Refunds exclude any applicable processing or administration fees charged by the booking platform or payment provider. You may send another person in your place if you cannot attend. Transfers to another session are permitted if requested more than 7 days before the booked Service. Transfers requested within the 7-day window will only be allowed in cases of illness supported by a valid medical certificate. No processing or administration fee will be charged for transfers at this time. However, if such fees are introduced by the booking platform in the future, these may be passed on to you. Non-medical cancellations within 7 days are non-refundable and non-transferable regardless of reason.

5. No-shows and Late Arrivals: If you fail to attend a booked Service without prior notice, your booking will be treated as a no-show and no refund or transfer will be provided. Late arrival does not extend the scheduled Service time.

6. Cancellations and Changes (Our-initiated): We reserve the right to cancel or reschedule a Service due to low registrations, presenter illness, or other unforeseen circumstances. In such cases, you may choose either a full refund or transfer to another date. Refunds will be processed within 10 business days of cancellation.

7. Participant Conduct: We reserve the right to remove any participant from a Service without refund if they are disruptive, disrespectful, or breach group agreements. Examples include, but are not limited to: harassment, abusive language, discriminatory comments, repeated interruption, or behaviour that compromises the safety or wellbeing of other participants.

8. Confidentiality and Recording: To protect the privacy of all participants, you must not record, photograph, or otherwise capture any part of a Service (including online delivery) without our prior written consent. You must not share or distribute any content from a Service without permission.

9. Force Majeure: We are not responsible for any failure or delay in performing our obligations under these Terms where such failure or delay is due to events beyond our reasonable control, including but not limited to natural disasters, acts of government, public health emergencies, internet outages, strikes, or illness. In such cases, we will make reasonable efforts to reschedule the affected Service.

10. Nature of Services: Workshops: Our workshops are educational in nature and are not a substitute for individual therapeutic support. They provide general information and group-based learning. One-on-one sessions: Our one-on-one grief support sessions are therapeutic services delivered within the professional scope of a qualified and registered social worker. These sessions provide specialist support for grief and loss, in alignment with the Australian Association of Social Workers’ professional standards. They are not a substitute for medical or psychiatric treatment when such treatment is required.

11. Liability: To the fullest extent permitted by law, we are not liable for any loss, injury, or damage arising from your participation in a Service. Where liability cannot be excluded under the Australian Consumer Law, our liability is limited to resupplying the Service or providing a refund.

12. Acknowledgements (Online Bookings): All online bookings require you to confirm the following via tick boxes before purchase: Agreement to Terms – “I have read and agree to the Service Terms and Conditions.” Nature of Service Acknowledgement – “I understand that My Condolences Workshop is educational in nature and that one-on-one grief support sessions are therapeutic services delivered by a qualified and registered social worker. I acknowledge that these Services are not a substitute for medical or psychiatric treatment when such treatment is required. I remain responsible for my own wellbeing.”

13. Governing Law: These Terms are governed by the laws of Western Australia, and you agree to submit to the exclusive jurisdiction of its courts.
